After reading the Horvath/Kelly letter, Levy apparently took steps to authenticate it. Having traced the Marr telephone call to the Villanova restaurant on 46th Street in Manhattan – the same restaurant at which prosecution witnesses Mildred Balitzer/Harris and Joe Bendix both claimed to have had meetings with Luciano – Levy then apparently spoke with owner Joe Carroll. According to Carroll, the Horvath/Kelly letter was originally written in the ladies room at the Villanova.
Following his conversation with Carroll, Levy dictated a second memo to the file on June 9, 1936, memorializing what had occurred.
